If you believe that any content available on or through our game launcher infringes upon your copyright, we encourage you to submit a Notice of Alleged Infringement ("DMCA Notice") to our designated inbox for Intellectual Property Takedown Request at copyrights@elixir.games Please note that you may be held accountable for damages, including costs and attorneys' fees, if you make any material misrepresentations in an Intellectual Property Takedown Request Notice.
A valid Intellectual Property Takedown RequestNotice must include the following information:
Your Information: Your full legal name, mailing address, telephone number, and email address. If you are acting on behalf of a company or other entity, include your title and relationship to the entity.
A Physical or Electronic Signature: Your Intellectual Property Takedown Request Notice must include your physical or electronic signature, or that of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the Copyrighted Work: You must identify the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single Intellectual Property Takedown Request Notice, provide a representative list of such works.
Identification of the Infringing Material: A sufficient description of where the infringing material is located on our game launcher. This should include, at minimum, the precise URL(s) or other unique identifiers that direct to the alleged infringing content.
Statement of Infringement: You must provide a statement that you have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
Statement of Accuracy: Your Intellectual Property Takedown Request Notice must include a statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Required Language: The following language must be included in your Intellectual Property Takedown Request Notice: "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use). I hereby state that the information in this Intellectual Property Takedown Request Notice is accurate, and under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
Our designated Copyright Agent can be reached at copyrights@elixir.games Please send your completed Intellectual Property Takedown Request Notice to this address. We aim to respond to all valid Intellectual Property Takedown Request Notices within ten (10) business days.
If you believe that your content was removed or access to it was disabled by mistake or misidentification, you have the right to submit a counter-notice to our designated Copyright Agent. Counter-notices must meet the statutory requirements imposed by the Intellectual Property Takedown Request . Please note that there may be adverse legal consequences if you make any material misrepresentations in a counter-notice.
A valid Intellectual Property Takedown Request Counter-Notice must contain the following:
Your Information:Your full legal name, mailing address, telephone number, and email address. If the counter-notice is on behalf of a company or other entity, include your title and relationship to the entity.
Your Physical or Electronic Signature:Your counter-notice must include your physical or electronic signature.
Identification of Removed Content:A sufficient description and the specific location on our game launcher of the material that has been removed or to which access has been disabled. This should include the URL or other unique identifiers of the removed content.
Statement of Consent:A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. Include the following language: "I consent to the jurisdiction of the Federal District Court for the District of Delaware. I will accept service of process from the person who provided the original DMIntellectual Property Takedown Request CA Notice or an agent of such person."
Request for Restoration:A clear and specific request for us to restore the removed material or cease disabling access to it.
Our designated Copyright Agent can be reached at copyrights@elixir.games Please send your completed counter-notice to this address. Upon receipt of a valid counter-notice, we will promptly forward a copy to the person who filed the original Intellectual Property Takedown Request Notice. If we do not receive notice from the original claimant that they have filed a legal action relating to the allegedly infringing material within ten (10) business days, we may restore the removed material or cease disabling access to it.
In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we maintain a policy of terminating the accounts of users who repeatedly infringe the copyrights of others. A "repeat infringer" is a user who has been notified of infringing activity more than twice and/or has had a piece of content removed from our game launcher due to a copyright complaint more than twice.
To enforce this policy, we keep track of Intellectual Property Takedown Request Notices and counter-notices we receive and actions we take based on them. Here's our procedure:
First Infringement: After the first valid Intellectual Property Takedown Request Notice, the user is sent a warning email informing them of the infringement and the consequences of further violations. The infringing content is removed or access to it is disabled.
Second Infringement: If we receive a second valid Intellectual Property Takedown Request Notice about the same user, the user will receive another warning and the infringing content will be removed or disabled. The user may also face temporary suspension from our game launcher.
Third Infringement: If we receive a third valid Intellectual Property Takedown Request Notice about the same user, the user will be considered a "repeat infringer." Their account may be permanently terminated, and they may be banned from creating new accounts.
Please note that we may terminate user accounts and/or remove content at any time for any reason, including first-time infringements in certain cases, if the infringement is of a particularly serious nature. We also reserve the right to refuse service to anyone, whether they are a repeat infringer or not.
